Please read these Terms of Use carefully before using the AddaVolt website operated by AddaVolt. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site.
By accessing or using any part of the AddaVolt EV charging platform-including but not limited to AddaVolt charging stations, the AddaVolt mobile application, website, mobile wallet, maps, and any related services-you acknowledge and agree that you have read, understood, and will be bound by these Terms of Use. If you do not accept these Terms, you must not use the Services. Your continued use of the Services constitutes your ongoing acceptance of these Terms, including any future modifications.
You agree to use AddaVolt charging stations exclusively for the purpose of charging electric vehicles that comply with industry standards and manufacturer specifications. It is your responsibility to ensure that your vehicle is compatible with the charging equipment provided by AddaVolt prior to initiating a charging session. You must follow all operational procedures, safety instructions, and posted guidelines at the charging station and within the AddaVolt app or website. Use of chargers for non-approved purposes, such as charging non-vehicle devices, using unauthorized adapters, or attempting to modify, tamper with, or repair the charging equipment, is strictly prohibited and may result in immediate suspension or termination of your account, as well as liability for any resulting damages.
You acknowledge and agree that the use of AddaVolt’s charging infrastructure and digital platform is entirely at your own discretion and risk. AddaVolt does not guarantee that every charger will be compatible with every make or model of electric vehicle, nor does AddaVolt guarantee uninterrupted, error-free, or continuous operation of its charging stations, mobile wallet, maps, or digital platform. You are solely responsible for verifying that your vehicle is in proper working order and suitable for charging at AddaVolt stations. AddaVolt is not responsible for any damage to your electric vehicle, its battery, or any onboard systems resulting from the use of AddaVolt’s chargers, regardless of the cause, including but not limited to incompatibility, electrical faults, power surges, user error, or third-party actions. Your decision to use AddaVolt’s charging infrastructure is voluntary and undertaken at your own risk.
If you create an account on the AddaVolt app or website, you agree to provide accurate, current, and complete information as required for registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account, whether authorized or unauthorized. You must promptly notify AddaVolt of any unauthorized use of your account or any other breach of security. AddaVolt is not liable for any losses arising from unauthorized access to your account.
The AddaVolt mobile wallet feature allows you to store value, top up your balance, and pay for charging sessions and related services. By using the mobile wallet, you authorize AddaVolt to deduct applicable fees, session charges, and any other amounts due from your wallet balance. You are solely responsible for maintaining a sufficient balance and for the security of your wallet credentials.
AddaVolt partners with third-party payment processors to facilitate credit card payments, load top-ups, and other transactions. You agree that AddaVolt may share necessary payment and transaction information with these processors for the purpose of completing your transactions. AddaVolt is not responsible for delays, failures, or errors caused by third-party payment processors, banks, or card issuers. Pre-authorization of your payment method may be required prior to starting a charging session. Any disputes regarding payments processed by third parties must be addressed directly with the respective payment provider.
All payments for charging sessions and wallet top-ups are non-refundable except as required by law or explicitly stated in these Terms. If your wallet or account is closed or expires, you may request a refund of any remaining balance, subject to applicable fees and regulatory requirements. Unclaimed balances after the statutory period may be forfeited or handled in accordance with applicable law.
You acknowledge that AddaVolt, charging site hosts, or parking operators may impose additional service fees, parking fees, or other charges. AddaVolt is not liable for any such fees, which are solely between you and the respective third party.
AddaVolt’s app and website may provide maps, route planning, and location-based services to help you find charging stations and plan your journeys. These features rely on third-party data and real-time information, which may not always be accurate, complete, or up-to-date. AddaVolt does not guarantee the availability, accuracy, or reliability of maps, station locations, connector types, real-time status, or route recommendations. You are solely responsible for verifying all information before relying on it for your travel or charging needs.
You are required to move your vehicle promptly after your charging session is complete. AddaVolt may impose idle fees or penalties if your vehicle remains connected to the charger or occupies the parking space beyond the allowed grace period after charging is finished. These fees are intended to ensure fair access to the charging infrastructure for all users and may be charged automatically to your account.
AddaVolt strives to maintain high uptime of its charging stations and cloud infrastructure, but does not guarantee any specific level of uptime or uninterrupted service. Scheduled maintenance, technical issues, force majeure events, or actions by third parties may result in temporary unavailability of chargers, the app, or wallet features. AddaVolt is not liable for any losses or inconvenience caused by downtime, outages, or service interruptions, regardless of cause. AddaVolt will make reasonable efforts to notify users of planned maintenance or major outages, but is not obligated to provide advance notice.
AddaVolt provides customer service and technical support through its app, website, and designated support channels. While AddaVolt aims to respond to inquiries and resolve issues in a timely manner, it does not guarantee any specific response time or resolution. AddaVolt reserves the right to prioritize, limit, or refuse support in cases of abusive conduct, repeated violations of these Terms, or misuse of the Services.
By using the Services, you consent to AddaVolt collecting, storing, and processing information about you and your use of the platform. This may include personal data (such as name, contact details, payment information), session data (such as charging session date, time, duration, energy dispensed, location), device and network data (such as IP address, app identifiers, usage patterns), and precise or general location data. AddaVolt may also collect data on your interactions with maps, route planning, and wallet features.
AddaVolt uses collected data to operate, improve, and personalize the Services, to process payments, to provide customer support, to comply with legal obligations, and for business analytics. AddaVolt may share data with its partners, service providers, payment processors, and regulatory authorities as needed to provide or improve the Services, or as required by law. AddaVolt may use aggregated or anonymized data for research, reporting, or commercial purposes.
While AddaVolt implements reasonable security measures to protect your data, no system is completely secure. AddaVolt is not liable for unauthorized access, loss, or disclosure of data resulting from circumstances beyond its reasonable control, including actions of third parties or force majeure events.
You are expected to conduct yourself in a manner that does not harm, inconvenience, or endanger other users, AddaVolt staff, or the property of AddaVolt or its partners. Any form of harassment, vandalism, fraud, or unsafe behavior may result in the suspension or termination of your access to the Services and may expose you to civil or criminal liability. You may not resell, assign, or make unauthorized commercial use of the Services. Only the registered user/account holder may use the charging session; sharing your account or allowing others to use your session is prohibited.
AddaVolt provides its Services “as is” and does not make any warranties, expressed or implied, regarding the availability, reliability, or suitability of the charging stations, app, wallet, maps, or website for your specific needs. AddaVolt expressly disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. The availability of charging stations, the performance of the app, wallet, maps, and the accuracy of information displayed (such as real-time charger status or availability) are not guaranteed. AddaVolt may modify, suspend, or discontinue any aspect of the Services at any time without notice.
AddaVolt is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the charging stations, mobile app, wallet, maps, or website. In particular, AddaVolt assumes no responsibility and shall not be liable for any damage to your electric vehicle, its battery, or any onboard systems resulting from the use of AddaVolt’s chargers, regardless of the cause. This limitation includes, but not limited to, damages arising from incompatibility, electrical faults, power surges, user error, third-party actions, payment processor errors, map inaccuracies, or service interruptions. The decision to use AddaVolt’s charging infrastructure and platform is entirely at your own risk, and you re solely responsible for verifying that your vehicle and devices are in proper working order and suitable for use with our Services.
AddaVolt’s liability, if any, for any claim arising out of or relating to your use of the Services shall be strictly limited to the amount you have paid to AddaVolt for charging services in the six months preceding the event giving rise to the claim, or five thousand Philippines pesos (₱5,000), whichever is lower. In no event shall AddaVolt be liable for any loss of profits, loss of data, or any special, incidental, or consequential damage, even if AddaVolt has been advised of the possibility of such damages.
You agree to indemnify and hold harmless AddaVolt, its officers, employees, partners, and affiliates from and against any claims, damages, liabilities, costs , or expenses (including reasonable attorney’s fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.
AddaVolt reserves the right, at its sole discretion, to suspend or terminate your access to the charging stations, app, wallet, maps, or website at any time and for any reason, including but not limited to violations of these Terms, suspected fraudulent activity, safety concern, or as required by law or regulatory authorities. You may close you account at any time via the app or by contacting AddaVolt support.
All intellectual property rights in the app, website, charging station software, wallet, maps, and related content are owned by AddaVolt or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app and website solely for personal, non-commercial purposes related to charging your electric vehicle. You may not reverse engineer, copy, or attempt to derive source code from the app or any AddaVolt platform.
AddaVolt may update or cahnge these Terms at any time. Any changes will be effective immediately upon posting in the app or on the website. Your continued use of the Services after such changes constitutes you acceptance of the revised Terms
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising under or in connection with these Terms shall be resolved first through mediation, and if unresolved, through binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).
