Terms of Service

These Terms of Use govern your access to and use of the AddaVolt EV Charging Network, operated by AddaVolt. By using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our Service.

1. General Terms and Usage

1.1 Eligibility:

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
By using the Service, you represent and warrant that you meet these eligibility requirements.

1.2 Registration & Account:

Users may be required to create an account to access certain features of the Service.
You agree to provide accurate, current, and complete information during registration and update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

1.3 Accepted Use:

You agree to use the Service solely for lawful purposes and in accordance with these Terms.
Prohibited conduct includes, but is not limited to, using the Service to commit fraudulent acts, interfere with its operation, or access areas not intended for public use.

2. Charging Service

2.1 Service Description:

AddaVolt provides a network of EV charging stations located at partner sites.
The Service allows EV users to initiate, monitor, and complete charging sessions via our mobile app or web portal.

2.2 Payment & Revenue Sharing:

Charges are calculated on a per-kWh basis at the prevailing rate (e.g., PHP 30 per kWh).
After deduction of the electricity cost (e.g., PHP 15 per kWh), the remaining profit is shared between AddaVolt and the site host. The host receives 20% of the profit, and AddaVolt retains 80%.
All payments are processed securely through our integrated payment gateways (e.g., PayMaya, GCash, and credit card providers).

2.3 Session Initiation & Termination:

To begin a charging session, you must authenticate using your registered account and select a nearby station via our app.
Once a session is initiated, charging continues until the session is manually ended or the battery reaches full capacity.
You are responsible for monitoring the session to ensure that charging terminates appropriately.

2.4 Service Availability:

The Service is provided “as is” and on an “as available” basis. We strive for high uptime; however, we do not guarantee uninterrupted Service.
Scheduled maintenance and unforeseen outages may occur, and you agree that these interruptions are not a breach of these Terms.

3. Liability Limitations

3.1 Disclaimer of Warranties:

Our Service is provided without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will meet your requirements, be error-free, or operate without interruption.

3.2 Limitations of Liability:

To the maximum extent permitted by law, AddaVolt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.
AddaVolt’s total liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid, if any, to access the Service during the six (6) months preceding the claim.

3.3 Force Majeure:

AddaVolt shall not be held liable for any failure to perform due to causes beyond its reasonable control, including natural disasters, acts of government, failure of suppliers, or other events beyond our control.

3.4 No Professional Advice

The information provided through the Service is for general informational purposes only and does not constitute professional advice. AddaVolt is not liable for any decisions made based on the information provided through the Service.

4. User Limitations

4.1 User Responsibilities:

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.
You agree not to misuse the Service, including attempts to bypass or tamper with any charging controls, security features, or payment processing functionalities.

4.2 Prohibited Activities:

You must not attempt to gain unauthorized access to any portion of the Service or interfere with the proper functioning of the Service.
You agree not to use any automated systems or software to extract data from the Service or engage in any activity that could harm the Service, its infrastructure, or its users.

4.3 User Data and Privacy:

By using the Service, you consent to our collection, use, and disclosure of your information in accordance with our Privacy Policy.
You agree not to share your account credentials or permit others to use your account, as you are solely responsible for all actions taken under your account.

4.4 Termination of Use:

AddaVolt reserves the right to suspend or terminate your access to the Service, without notice, if you violate these Terms or engage in any conduct that may harm the interests of the Service or its users.
Upon termination, you must immediately cease all use of the Service and delete any copies of related content in your possession.

5. General Provisions

5.1 Changes to Terms:

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and become effective immediately upon posting.
Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

5.2 Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the Philippines.
